Hyperdope LLC ("we", "us", "our") respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

All content on hyperdope.com is either:

• Owned by Hyperdope LLC or our content partners
• Licensed from original creators
• Used with explicit permission
• Believed to be authorized for distribution

If you believe content on our Service infringes your copyright, please follow the procedure below.

3. Filing a DMCA Takedown Notice

3.1 Required Information

To file a valid DMCA takedown notice, you must provide the following information in writing:

   • Include title, registration number (if applicable), or other identifying information
2. Identification of the infringing material and its location on our Service
   • Provide the specific URL(s) where the material is located
   • Example: https://hyperdope.com/video/[video-hash]
   • Sufficient detail for us to locate the material
3. Your contact information
   • Full legal name
   • Mailing address
   • Email address
   • Phone number
4. A statement that you have a good faith belief that use of the material is not authorized by:
   • The copyright owner
   • The copyright owner's agent
   • The law
5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
6. Your physical or electronic signature
   • Type your full legal name (electronic signature)
   • Or provide a scanned handwritten signature

3.3 Incomplete Notices

Notices that do not include all required information may not be processed. We may contact you to request missing information, but we are not obligated to do so.

4. Our Response to Valid Notices

Upon receiving a valid and complete DMCA takedown notice, we will:

1. Remove or disable access to the allegedly infringing content promptly (typically within 24-48 hours)
2. Notify the content source (if known) that the material has been removed or disabled
3. Document the takedown for our records and potential counter-notices
4. Evaluate for repeat infringers (see section 6 below)

We will send confirmation to the email address provided in your notice.

5. Counter-Notices

If you believe your content was wrongly removed due to a DMCA notice, you may file a counter-notice.

5.1 Counter-Notice Requirements

A valid counter-notice must include:

1. Your contact information (name, address, email, phone)
2. Identification of the removed material and its location before removal
3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
4. Your consent to jurisdiction of the Federal District Court for the judicial district in which your address is located (or Wyoming if outside the U.S.)
5. Your consent to accept service of process from the person who filed the original DMCA notice
6. Your physical or electronic signature

5.2 Counter-Notice Process

Upon receiving a valid counter-notice, we will:

1. Forward the counter-notice to the original complainant
2. Wait 10-14 business days
3. Restore the content if the complainant does not file a court action

6. Repeat Infringer Policy

We will terminate access to the Service for users or content sources who are repeat copyright infringers.

Repeat Infringer Definition:

• Content source that has been subject to multiple valid DMCA takedowns
• Content source that repeatedly uploads infringing content after previous removals

Actions We Take:

• First infringement: Content removed, warning issued
• Second infringement: Content removed, final warning
• Third infringement: All content from that source removed, source permanently banned

7. Misrepresentation

Warning: Under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that material is infringing (or was removed by mistake) may be subject to liability for damages, including costs and attorney's fees.

Do not make false copyright claims. We may pursue legal action against those who abuse the DMCA process.

8. Fair Use Consideration

We respect fair use rights under copyright law. Before filing a DMCA notice, please consider whether the content use qualifies as fair use, such as:

• Commentary or criticism
• News reporting
• Educational purposes
• Transformative use

If you believe content is fair use, you may file a counter-notice (see section 5).
