3. Filing a DMCA Takedown Notice

3.1 Required Information

To file a valid DMCA takedown notice, you must provide the following information in writing:

  1. Identification of the copyrighted work claimed to be infringed
  2. Identification of the infringing material and its location on our Service
  3. Your contact information
  4. A statement that you have a good faith belief that use of the material is not authorized by:

3.3 Incomplete Notices

Notices that do not include all required information may not be processed. We may contact you to request missing information, but we are not obligated to do so.

4. Our Response to Valid Notices

Upon receiving a valid and complete DMCA takedown notice, we will:

  1. Remove or disable access to the allegedly infringing content promptly (typically within 24-48 hours)
  2. Notify the content source (if known) that the material has been removed or disabled
  3. Document the takedown for our records and potential counter-notices
  4. Evaluate for repeat infringers (see section 6 below)

We will send confirmation to the email address provided in your notice.

5. Counter-Notices

If you believe your content was wrongly removed due to a DMCA notice, you may file a counter-notice.

5.1 Counter-Notice Requirements

A valid counter-notice must include:

  1. Your contact information (name, address, email, phone)
  2. Identification of the removed material and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your consent to jurisdiction of the Federal District Court for the judicial district in which your address is located (or Wyoming if outside the U.S.)
  5. Your consent to accept service of process from the person who filed the original DMCA notice
  6. Your physical or electronic signature

5.2 Counter-Notice Process

Upon receiving a valid counter-notice, we will:

  1. Forward the counter-notice to the original complainant
  2. Wait 10-14 business days
  3. Restore the content if the complainant does not file a court action
