Hyperdope Terms of Service

1. Acceptance of Terms

By accessing or using hyperdope.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Hyperdope LLC ("we", "us", "our") operates this Service.

2. Description of Service

Hyperdope is a curated video content platform that allows:

Viewing free video content
Sending Bitcoin/Lightning tips
Purchasing access tokens for premium content

The Service is provided "as is" without guarantees of uptime, availability, or fitness for any purpose.

3. Content Curation

All content on the Service is hand-selected by our editorial team for educational, historical, and curatorial purposes. We do not currently allow open user uploads. Content includes:

Content we own or created: Original content produced by Hyperdope LLC
Authorized content: Content distributed with explicit creator permission and licensing agreements
Fair use content: Content we believe qualifies as fair use under 17 U.S.C. § 107 for purposes including:
- Education and instruction
- Historical preservation and archiving
- Commentary and criticism
- News reporting and current events
- Transformative curation and contextualization
Public domain content: Content in the public domain or under Creative Commons licenses

We make good-faith determinations about fair use and actively seek to work with original creators to establish authorized distribution and revenue sharing arrangements. We will promptly address any copyright concerns from original creators.

4. No User Accounts

We do not require user accounts for viewing or purchasing access. Access to premium content is granted via cryptographic access tokens stored locally in your browser. We do not store user credentials, personal information, or payment details.

You are responsible for:

Maintaining your browser's local storage (clearing it will remove your access tokens)
Backing up tokens if desired (we cannot recover lost tokens)
Keeping your device secure

5. Bitcoin/Lightning Payments

5.1 Payment Processing

All payments are processed via Bitcoin/Lightning Network through BTCPay Server. We do not handle credit cards or traditional payment methods.

5.2 No Chargebacks

Bitcoin and Lightning payments are final and irreversible. There are no chargebacks, refunds, or payment disputes. By making a payment, you acknowledge and accept this.

5.3 Tips and Platform Support

Tips sent via Lightning support the Hyperdope platform and curation efforts.

For content we own or have licensed:

Tips may be shared with original creators per revenue sharing agreements

For fair use content:

Tips currently support platform operations (hosting, curation, development)
We actively seek to establish revenue sharing with original creators
If a creator claims their content and requests removal, we will either:
- Remove the content promptly, OR
- Offer a revenue sharing arrangement to keep content available

Future Creator Revenue Sharing: We plan to implement automatic revenue sharing where tips will be split between Hyperdope and the original content creator. When this feature launches:

Creators will be able to claim their accounts and provide a Lightning address
Tips will be automatically split between Hyperdope and the creator
If payment to a creator fails (node offline, invalid address, etc.), the full tip amount will default to Hyperdope
Creators are responsible for maintaining a working Lightning address to receive payments
We do not custody funds or settle up failed payments—Lightning payments are instant or they fail

Transparency: It is always clear whether tips go to the platform, a creator, or are split. The tip interface displays the recipient.

All tips are voluntary contributions and non-refundable.

5.4 Access Tokens

Access tokens (24-Hour Access and Lifetime Access Tokens) are available ONLY for:

Content owned by Hyperdope LLC
Content licensed from creators who have explicitly authorized paid access
Content where we have obtained commercial distribution rights

We do NOT sell access to fair use content. Fair use content remains freely viewable to support educational and curatorial purposes.

Available access options:

24-Hour Access: Access expires 24 hours after purchase
Lifetime Access Token: Permanent access (token does not expire)

Access token purchases are non-refundable. Lost tokens cannot be recovered.

5.5 Pricing

Prices are displayed in satoshis (sats) and may include USD equivalent estimates. Bitcoin/Lightning exchange rates fluctuate. The satoshi price is final; USD estimates are for reference only.

6. Content and Intellectual Property

6.1 Our Content

All content displayed on the Service is either:

Owned by Hyperdope LLC
Licensed from creators or rights holders
Used with permission

6.2 Creator Rights

Original creators retain ownership of their content. By allowing us to distribute content, creators grant us a license to host, display, and deliver their content via the Service.

6.3 Your Use

When you purchase an access token, you receive a limited, non-exclusive, non-transferable license to view the content for personal, non-commercial use only.

You may NOT:

Download, copy, or redistribute content
Use content for commercial purposes
Remove or modify copyright notices
Share or transfer access tokens

6.4 Prohibited Conduct

You may not:

Attempt to circumvent access controls or payment systems
Use automated tools to scrape or download content
Reverse engineer access tokens or security measures
Interfere with the Service's operation or security
Violate any applicable laws

6.5 Creator Collaboration

We respect original creators and actively seek partnerships. If you created content on our platform:

You may contact us to:

Claim your content and establish your identity as the creator
Request content removal (we will comply promptly)
Propose a revenue sharing arrangement to keep content available
Provide a Lightning address to receive future tips and revenue share

Our commitment:

Prompt response to creator inquiries
Good faith negotiations for revenue sharing
Transparent reporting of tips and access token sales
Respect for creator decisions regarding their content

7. Content Removal

We reserve the right to remove content that:

Violates these Terms
Violates applicable law
Is subject to valid DMCA takedown requests
Poses security or technical risks

We are not obligated to monitor content but may do so at our discretion.

8. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, see our DMCA Policy for takedown procedures.

9. Privacy

We collect minimal data. See our Privacy Policy for details.

Key points:

No user accounts = no personal data required
Access tokens stored locally in your browser (not on our servers)
Server logs (IP addresses) retained for 30 days, then deleted
We do not sell or share your data

10. Disclaimers and Limitations of Liability

10.1 No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free operation
Accuracy or reliability of content

10.2 Lightning Network Risks

Bitcoin and Lightning Network transactions carry inherent risks:

Payments are irreversible
Network fees may vary
Transactions may fail (rare, but possible)
Lightning node availability affects payment success

You are responsible for understanding these risks before making payments.

10.3 Creator Payment Failures

When creator revenue sharing is implemented, we are not responsible for:

Failed payments due to creator's offline node or invalid Lightning address
Lost revenue from creator's outdated or incorrect payment information
Custodying funds or settling failed payments after the fact

Lightning payments are instant and final. Creators are responsible for maintaining working Lightning infrastructure.

10.4 Limitation of Liability

To the maximum extent permitted by law, Hyperdope LLC shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Damages arising from Service interruptions or content removal
Damages exceeding the amount you paid us in the preceding 12 months

Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. This includes but is not limited to:

Violation of these Terms
Abuse of the Service
Technical or security issues
Discontinuation of the Service

Termination does not entitle you to refunds for previous payments (all Bitcoin/Lightning payments are final).

12. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

Material changes (such as implementing creator revenue sharing) will be announced on the homepage.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Any disputes shall be resolved in the courts of Wyoming.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and Hyperdope LLC regarding the Service.
